ROLLERINA SKATE CO. – LIABILITY WAIVER, RELEASE OF CLAIMS & ASSUMPTION OF RISK AGREEMENT
PLEASE READ CAREFULLY BEFORE SIGNING
This Liability Waiver, Release of Claims, Assumption of Risk, Medical Authorization, and Media Release Agreement ("Agreement") is entered into by the undersigned participant, or by the parent/legal guardian on behalf of a minor participant, in consideration for being permitted to participate in any Rollerina Skate Co. activities, including but not limited to skating sessions, routes, lessons, meetups, events, classes, workshops, and related activities.
1. ASSUMPTION OF RISK
I acknowledge that roller skating, inline skating, and related activities involve inherent and significant risks, including but not limited to:
Falls, collisions, and contact with other participants, spectators, vehicles, or objects
Uneven surfaces, pavement defects, environmental hazards, weather conditions, and obstacles
Equipment failure, misuse, or malfunction
Physical exertion and unforeseen medical conditions
Serious bodily injury, permanent disability, emotional injury, illness, property damage, or death
I understand that these risks may arise from my own actions, the actions of others, the condition of the skating environment, equipment, or the negligence of the Released Parties (defined below). I knowingly and voluntarily assume all such risks, whether known or unknown, and accept full responsibility for my participation.
2. PARTICIPANT RESPONSIBILITIES
I agree to:
Follow all safety instructions, rules, and guidelines provided by Rollerina Skate Co.
Conduct myself responsibly and respectfully toward instructors, volunteers, staff, and fellow participants
Use equipment properly and safely
Immediately remove myself from participation and notify a Rollerina Skate Co. representative if I observe any unsafe condition, hazard, injury, or concern regarding my readiness to participate
Rollerina Skate Co. reserves the right to remove any participant from an activity for unsafe behavior, rule violations, or conduct that endangers others.
3. RELEASE OF LIABILITY, WAIVER OF CLAIMS & INDEMNIFICATION
To the fullest extent permitted by law, I, for myself and on behalf of my heirs, assigns, personal representatives, next of kin, and anyone acting on my behalf, hereby release, waive, discharge, indemnify, and hold harmless Rollerina Skate Co., its owners, founders, officers, directors, instructors, coaches, volunteers, employees, agents, affiliates, sponsors, advertisers, event organizers, sanctioned organizations, property owners, lessors, and all other associated persons or entities (collectively, the "Released Parties") from any and all claims, demands, causes of action, liabilities, damages, losses, costs, or expenses arising out of or related to my participation in Rollerina Skate Co. activities.
This release includes, without limitation, claims arising from:
I further agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, costs, or attorney's fees arising from my participation or conduct.
4. MEDICAL ACKNOWLEDGMENT & EMERGENCY AUTHORIZATION
I certify that I am physically capable of participating in skating activities and understand that it is my responsibility to seek medical advice if I have any health concerns.
In the event of an emergency where I am unconscious or otherwise unable to make medical decisions, I authorize Rollerina Skate Co. and emergency personnel to obtain medical treatment on my behalf, including transportation, hospitalization, surgery, anesthesia, and other medically necessary procedures.
I understand and agree that I am solely responsible for all medical expenses and related costs incurred as a result of treatment.
5. HELMET ACKNOWLEDGMENT & FLORIDA SKATING STATUTE
I acknowledge that wearing a helmet and protective equipment may reduce the risk of injury. I understand the provisions of Florida Statute §316.0085 and voluntarily assume all risks associated with participation in roller skating and inline skating activities.
Unless otherwise required by law or event policy, I reserve the right to choose whether or not to wear a helmet and accept full responsibility for that decision.
I further acknowledge that Rollerina Skate Co. is not liable to any person who voluntarily participates in roller skating or inline skating for injuries or property damage arising out of such participation in an area designated for those activities, as provided by applicable Florida law.
6. MINOR PARTICIPANTS
If signing on behalf of a participant under eighteen (18) years of age:
I certify that I am the parent or legal guardian of the minor participant.
I consent to the minor's participation in Rollerina Skate Co. activities.
I agree to all terms of this Agreement on behalf of the minor.
I accept full responsibility for the minor's conduct, safety, and participation.
I release and indemnify the Released Parties from any claims arising from the minor's participation.
7. MEDIA RELEASE
I grant Rollerina Skate Co. permission to photograph, record, and use my image, likeness, voice, and/or video recordings (or those of my minor child) for promotional, marketing, educational, social media, website, advertising, and other lawful business purposes without compensation or further approval.
I understand that Rollerina Skate Co. may edit, reproduce, publish, and distribute such materials in any media format now known or later developed.
8. GOVERNING LAW & VENUE
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
Any legal action arising from or relating to this Agreement shall be brought exclusively in the Circuit Court of the Ninth Judicial Circuit in and for Orange County, Florida, or if that court lacks subject matter jurisdiction, in another court of competent jurisdiction located in Orange County, Florida.
9. ACKNOWLEDGMENT OF UNDERSTANDING
By signing below, I acknowledge and agree that:
I have carefully read this entire Agreement.
I fully understand its contents and legal effect.
I understand that I am giving up substantial legal rights, including the right to sue.
I sign this Agreement voluntarily and without inducement.
I intend for this Agreement to be binding upon myself, my heirs, personal representatives, assigns, and next of kin.
Please ensure your emergency contact is aware of the sport or activity you are participating in and understands your wishes should they be contacted in the event of an emergency. Before participating, discuss your medical preferences with them, including whether you would want an ambulance to be called, any relevant medical conditions, allergies, medications, and any other information that may assist emergency responders if you are unable to communicate your wishes yourself. Chapter Leaders and volunteers are not medical professionals and will use their best judgment in responding to incidents. If they reasonably believe a participant is experiencing a medical emergency or requires urgent medical assessment, they will call 911. This may include, but is not limited to, loss of consciousness, difficulty breathing, chest pain, suspected head, neck, or spinal injuries, severe bleeding, seizures, significant allergic reactions, or any injury or illness where the participant cannot safely continue or where immediate medical attention is considered appropriate.
Participants should ensure their emergency contact is aware that Chapter Leaders and volunteers may contact emergency services if they believe it is necessary for the participant's safety.
